Information You Provide Through Your Account
This is information that you provide to us through text fields, such as your name, payment information and benefits. The information we collect differs depending on if you make an account, become a fan, or become a creator.
You also have the option to add more information to your public profile, which we store along with any comments or messages you submit on RoosterClubs.
A fan is someone who joins RoosterClubs’ membership platform to support a creator’s membership content. As a fan you must provide your payment information to our payment processor, Stripe. You can see the privacy policy for these payment processors on the Stripe site. At this time, RoosterClubs does not receive your full card number. Payment processors provide us with a token that represents your account, your card’s expiration date, card type and the last four digits of your card number. If you are required to provide your name and email address to the payment processor, then they also provide us with that information.
We collect and process information about the creators you support, the level at which you support them, what benefits you receive and how often you support them.

Additional Information We Collect
We collect information automatically as you navigate the site or through our third party analytics providers. We may store usage information such as the type of device you use to access RoosterClubs, your operating system, browser type, IP address, and device ID, the pages you visit or request, links clicked, referring sites, user interactions and your search terms. We also derive your location from your self-disclosed country, your IP address, and from your payment card.
From time to time, we may solicit your participation in user surveys. We may ask you demographic information, including information related to your gender, ethnicity, race, age, sexual orientation, earnings, and accessibility to better understand and serve our user base which you may elect to share or not. We collect such information to ensure we provide fair and equal access to our services, and to showcase creators to fans for greater discoverability. To the extent that you participate, we will store your survey responses.

Creators agree to the terms of our Data Processing Agreement (DPA) when they start their membership program. This DPA is called the Creator Privacy Promise. The Creator Privacy Promise is a creator’s promise to protect the privacy of their fans during and beyond their RoosterClubs relationship. See Appenix A to this Privacy Policy for the DPA.

Your Preferences and Rights over Data
The Settings link is located by clicking on the bar graph icon on the bottom right hand of your screen, after your log into your RoosterClubs account. Settings lets you see your account preferences. You can see and adjust your settings by viewing your preferences and, if you wish, by changing your selections.

You may object to the use of your data for marketing purposes at any time, free of charge, when we collect your personal information and in every marketing communication. You may also object to the use of your data for marketing upon creation of your account or anytime thereafter, by emailing accounts@roosterclubs.com.
Opting out will stop marketing emails. Please allow up to 30 days for your opt-out request to be processed. If you have an account with RoosterClubs, you will continue to receive service-related emails, and texts, if you have opted into receiving texts.
We do not sell your information to third parties for marketing purposes without your prior consent.
You can access and update certain information associated with your account on the settings pages. Additionally, you can delete your account, or export your personal information, by emailing accounts@roosterclubs.com
You may self-initiate a deletion of your account by emailing accounts@roosterclubs.com. Please be aware that this is a final act and cannot be reversed.
You can change your email notifications by emailing accounts@roosterclubs.com. While this allows you to stop many notification emails, we will still send some critical service emails.
Users maintain password protected accounts with RoosterClubs. If you submit a request to exercise your privacy rights, you will be asked to verify the request by logging into your RoosterClubs account.
If we are unable to verify your request, then for your protection, we reserve the right to deny the request.
Compliance with California Privacy Laws
Effective January 1, 2020, the California Consumer Privacy Act (CCPA) allows California residents to request access to the specific pieces and categories of personal information that the business has collected about the consumer, the categories of sources for that information, the business or commercial purposes for collecting the information, and the categories of third parties with which the information was shared.
RoosterClubs provides California residents, and all users, the right to view, access, or transport their information by emailing accounts@roosterclubs.com. All users also have the right to submit a request for deletion of information by emailing this address.
Exercising Your Data Rights
Users in certain locations may have certain rights under the General Data Protection Regulation (GDPR) or under the California Consumer Privacy Act (CCPA) regarding data that RoosterClubs controls as a Data Controller as defined under the GDPR, including:

In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government ID, and the authorized agent’s valid government ID. We do not discriminate against users who exercise their privacy rights.
We retain your account information for ten years after your account is last active, unless you delete, or you request us to delete, your account. We may continue to retain some information, even after you delete your account if we are required to do so in order to comply with various laws.
The security of your personal information is important to us and we follow industry standards to protect it.
RoosterClubs is not directed at children under the age of 13, and children may not create an account or otherwise use RoosterClubs.
Cookies are not used to identify you personally and are not used for any purpose other than those described here.
Some cookie and similar technology functions are necessary and vital to ensuring that RoosterClubs works properly for visitors and members, such as maintaining the security, safety, and integrity on RoosterClubs, authentication and logging in (including remembering permissions and consents you have granted), and ensuring the ability to securely complete transactions.
Some technologies help provide performance data on how RoosterClubs is functioning in order to make improvements to the platform. Data collected on site and app functionality and speed, how RoosterClubs is used and detecting and gathering reporting on bugs helps improve RoosterClubs and the services we offer.
Cookies enable your personalized views and settings. Some cookies help us provide localized experiences — for example, by making sure you see RoosterClubs in your preferred language.
Some technologies help you to interact with social networks you are signed into while using RoosterClubs, such as logging in with the social network and other features you employ with the social network, or that are allowed in the social network’s privacy policy. These may be set and controlled by the social networks, and your preferences with those social networks.
We do not respond to web browser “Do-Not-Track” signals.
You can control the use of cookies at the individual browser level. If you reject or delete cookies, our Services may no longer function as intended. We may sometimes make changes to this policy. If we make material changes that adversely affect your rights under this policy, we will let you know by posting an announcement on the site or sending you an email in advance of the changes coming into effect. RoosterClubs empowers creators on our platform (“Creators”) to start membership businesses by directly connecting with their biggest fans and turning them into paying members (“Fans”)
To facilitate this direct connection with Fans and enable membership rewards and obligations to be fulfilled, RoosterClubs provides the personal data of Fans (“Fan Data”) to Creators. Creators then process Fan Data in order to provide Fans any and all products or services as part of that Creator’s membership business on RoosterClubs (collectively known as “Membership Services”). RoosterClubs requires all Creators to agree to this Data Processing Agreement (“Privacy Promise”) to ensure that Creators respect the privacy rights of Fans when processing Fan Data
This Privacy Promise is between RoosterClubs and Creators, taking effect from the moment a RoosterClubs account is created and applies exclusively to the Fan Data collected by RoosterClubs and provided to Creators for the purpose of running a membership business with RoosterClubs.
This Privacy Promise is an extension of RoosterClubs’ Terms of Service and Privacy Policy and will outline certain requirements for Creators to process Fan Data during and beyond their relationship with RoosterClubs
I. Definitions.
"Data Protection Legislation" means all applicable laws relating to privacy and the processing of personal data that may exist in any relevant jurisdiction, including, where applicable, the guidance and codes of practice issued by the supervisory authorities. Data Protection Legislation includes, but is not limited to, European Directives 95/46/EC and 2002/58/EC (as amended by Directive 2009/136/EC) and any legislation and/or regulation implementing or made pursuant to them, or which amends, replaces, re- enacts or consolidates any of them, including the General Data Protection Regulation (Regulation (EU) 2016/279).
"Good Industry Practice" means exercising the same skill, expertise and judgement and using facilities and resources of a similar quality as would be expected from a person who:(a) is skilled and experienced in providing the services in question, seeking in good faith to comply with his contractual obligations and seeking to avoid liability arising under any duty of care that might reasonably apply; (b) takes all proper and reasonable care and is diligent in performing his obligations; and (c) complies with the Data Protection Legislation.
The terms "data controller", "data processor", “subprocessor”, "data subject", "personal data", "processing", and "appropriate technical and organizational measures" shall be interpreted in accordance with Directive 95/46/EC, or other applicable Data Protection Legislation, in the relevant jurisdiction.
II. Scope. The parties agree that RoosterClubs is a data controller and that Creator is a data processor in relation to Fan Data that Creator processes in the course of providing Membership Services. The subject matter of the data processing, the types of personal data processed, and the categories of data subjects will be defined by, and/or limited to, those necessary to carry out the Membership Services. The processing to which this Privacy Promise applies will be carried out by Creator upon leaving the RoosterClubs platform. The subject matter, duration, nature, and purpose of the processing of the personal data as well as the type of personal data and categories of data subjects covered by this Privacy Promise are as follows:
The subject matter of the data processing is Fan Data.
The duration of the processing is for as long as Creator holds Fan Data
The nature and purpose of the processing under this Privacy Promise is limited to a Creator’s fulfillment of Membership Services to the Fan.
The type of personal data covered by this agreement is contact information, including but not limited to first name, last name, username, email address, shipping address and fanbase association.
The category of the data subjects are website users who sign up for memberships on RoosterClubs.
III. Data Protection. Creator shall adhere to the following requirements:
Processing as Instructed. Creators will process Fan Data only in accordance with the RoosterClubs Terms of Service and Privacy Policy, including this Privacy Promise, and only in compliance with Data Protection Legislation. The nature and purpose of the processing shall be limited to that necessary to carry out such instructions, and not for Creator's own purposes, or for any other purpose except as required by law. If Creator is required by law to process the personal data for any other purpose, Creator will inform Fan of such requirement prior to the processing unless prohibited by law from doing so.
Extent of Processing. Creator will process the personal data only to the extent, and in such manner, as is necessary for the provision of Membership Services.
Appropriate Technical and Organizational Measures. Creator will implement and maintain appropriate technical and organizational measures designed to protect the personal data against unauthorized or unlawful processing and against accidental loss, destruction, damage, theft, alteration or disclosure. The measures shall be appropriate to the harm which might result from any unauthorized or unlawful processing, accidental loss, destruction, damage or theft of the personal data and having regard to the nature of the personal data which is to be protected and as a minimum shall be in accordance with the Data Protection Legislation and Good Industry Practice.
Transfer to Third Parties. Creator will not give access to or transfer any personal data to any third party (including any affiliates, group companies or subcontractors) without the prior consent of RoosterClubs. Creator must also ensure the reliability and competence of such third parties, its employees or agents who may have access to the personal data processed in the provision of Membership Services, and must include in any contract with such third party provisions protecting Fan which are equivalent to those in this Privacy Promise and the Terms of Service and as are required by applicable Data Protection Legislation.
Reliability and Competence of Creator Personnel. Creator will take reasonable steps to ensure the reliability and competence of any Creator personnel who have access to Fan Data. Creator will ensure that all Creator personnel required to access the personal data are informed of the confidential nature of the personal data and comply with the obligations set out in this Privacy Promise.
Acknowledgement of Data Protection Legislation and Assistance. Creator will take all reasonable steps to assist RoosterClubs in complying with applicable Data Protection Legislation. For example, Creator will promptly inform RoosterClubs in writing if it receives: (i) a request from a data subject concerning any personal data; or (ii) a complaint, communication, or request relating to Fan’s obligations under Data Protection Legislation.
Destruction or Return of Property Upon Membership Services Completion. Creator will not retain any of the personal data for longer than is necessary to provide Membership Services. At the end of Membership Services, or upon Fan's request, Creator will securely destroy or return (at Fan’s election) the personal data to Fan.
Loss or Security Breach. If Creator becomes aware of any accidental, unauthorized or unlawful destruction, loss, alteration, or disclosure of, or access to Fan Data processed by Creator in the course of providing Membership Services, it will do the following:
Provide notice to RoosterClubs. Creator shall promptly and without undue delay notify RoosterClubs and provide RoosterClubs with: a detailed description of the Loss or Security Breach; the type of data that was the subject of the Loss or Security Breach; the identity of each affected person if known, and the steps Creator has taken or will take in order to mitigate and remediate such Security Breach, in each case as promptly as such information can be collected or otherwise becomes available (as well as periodic updates to this information and any other information RoosterClubs may reasonably request relating to the Loss or Security Breach); and
Investigate the Matter promptly. Creator shall promptly take action, at its own expense, to investigate the Loss or Security Breach and to identify, prevent and mitigate the effects of the Loss or Security Breach and to carry out appropriate recovery actions to remedy the Loss or Security Breach.
Compliance with Data Protection Legislation. Creator shall comply at all times with and assist RoosterClubs in complying with its applicable obligations under Data Protection Legislation. Creator shall provide reasonable information requested by RoosterClubs to demonstrate compliance with the obligations set out in this Privacy Promise. Creator will notify RoosterClubs immediately if, in Creator's opinion, an instruction for the processing of personal data given by RoosterClubs violates any country’s data privacy legislation.
